New Carto Petition Denied in Record Time

Friday, November 17, 2000

A petition for new hearing filed by attorney Brian Urtnowski on behalf of Willis Carto on Wednesday, November 15, 2000, has already been denied by the California Court of Appeal. Urtnowski’s motion asked that the Court of Appeal reconsider its devastating ruling of October 31, which completely supported the lower court’s multi-million dollar ruling in favor of Legion for the Survival of Freedom, the parent corporation of Institute for Historical Review. (The full text of the Court of Appeal’s ruling is available on-line.)

LSF/IHR did not receive confirmation of Carto’s intention to appeal until noon today (Friday, November 17). By the time LSF/IHR counsel called the Court later that same afternoon to verify the timetable for responding, the motion had already been considered by the justices, and denied.
