  1. Legion et al v. Foundation to Defend the First Amendment et al., Orange County (California) Superior Court case number 719141, filed October 18, 1993. Action arising out of Carto’s attempted armed and violent take-over of Legion offices on the pretext that he was acting on behalf of the landlord, the Foundation to Defend the First Amendment (FDFA), which he controls. Complaint for forcible entry and detainer of a residence, trespass, breach of contract (covenant of quiet enjoyment), assault, battery, false imprisonment, for temporary and permanent injunction and declaratory relief. Settled.
  2. Legion et al v. Foundation to Defend the First Amendment et al., Cross-complaint by Carto claiming Legion possessed his property (after his ejection from the premises and subsequent arrest). Settled, but relitigated by Carto in 1997 in Carto v. Raven, Weber, and Liberty Lobby, Carto v. Weber, Raven, et al.
  3. Kerr, Carto v. Legion, Orange County (California) Superior Court case number 720973, filed November 19, 1993. Suit brought by Carto in an attempt to depose the legally-constituted board of directors of Legion. Ruling in favor of defendant December 31, 1993.
  4. Kerr, Carto v. Legion, Court of Appeal case number GO16137. Lower court ruling in favor of Legion upheld August 28, 1996 (relitigated in Texas by Carto in Incorporators of the Legion for the Survival of Freedom Inc. v. Andrew Allen, Friedrich Berg, and John Curry). Applicant Carto’s subsequent application to file a late petition for rehearing and reconsideration denied September 25, 1996.
  5. Kerr, Carto v. Legion, Court of Appeal case number G021990, filed August 1, 1997. Petition for Writ of Review, or Writ of Mandate by Carto et al. Denied August 8, 1997.
  6. Historical Education Foundation v. Institute for Historical Review [IHR is a dba for the Legion], Orange County (California) Superior Court case number 726195, filed March 3, 1994. Harassment suit by Carto involving a non-existent entity and a fraudulent note. Defendant Legion awarded Judgment of Non-suit.
  7. HEF v. Institute for Historical Review, Court of Appeal case number G017213. Lower court ruling reversed on a technicality on appeal by plaintiffs. Case eventually voluntarily dismissed by plaintiffs.
  8. HEF v. Institute for Historical Review, a subdivision of the Legion for the Survival of Freedom, a non-profit Texas corporation, Orange County (California) Superior Court case number 726201, filed March 3, 1994. Harassment suit by Carto involving a non-existent entity and a fraudulent note. Dismissed with prejudice. After Carto refused to pay the sanctions against him and he failed to appear at a judgment debtor’s examination, a bench warrant was issued for his arrest.
  9. HEF v. Institute for Historical Review, a subdivision of the Legion for the Survival of Freedom, a non-profit Texas corporation. Court of Appeal case number G019869, filed May 31, 1996. Appeal of sanctions against Carto on technical grounds. Sanctions reversed and remanded March 7, 1997.
  10. HEF v. Institute for Historical Review, a subdivision of the Legion for the Survival of Freedom, a non-profit Texas corporation. Court of Appeal case number G020776, filed November 25, 1996. Writ of mandate and request for immediate stay. Denied November 27, 1996.
  11. Legion for the Survival of Freedom, Inc. v. Willis Carto et al., San Diego (California) Superior Court case number N64584, filed July 22, 1994. Action arising out of the diversion of $7.5 million dollars of the Legion by Carto et al. Multi-million dollar ruling in favor of the Legion November 21, 1996. Carto then for a fourth time relitigated the findings concerning who legitimately controls Legion in Incorporators of the Legion for the Survival of Freedom Inc. v. Andrew Allen, Friedrich Berg, and John Curry.
  12. Legion for the Survival of Freedom, Inc. v. Willis Carto et al., Court of Appeal case number D025498. The appeal of an award of sanctions against the Furrs and their attorneys. Lower court ruling upheld. Legion eventually had to ask the Court’s help in compelling payment of the sanctions, to which defendant’s counsel Urtnowski responded by filing Urtnowski v. Sampson, et al., although they did eventually pay up.
  13. Legion for the Survival of Freedom, Inc. v. Willis Carto et al., Court of Appeal case number D027959. The appeal of the Judgment itself, which has been stayed by the bankruptcy filings of the Cartos and Liberty Lobby.
  14. Legion for the Survival of Freedom, Inc. v. Willis Carto et al., Court of Appeal case number D029122, filed August 1, 1997. Defendants’ massive petition for Writ of Mandate. Denied August 7, 1997.
  15. Legion for the Survival of Freedom, Inc. v. Willis Carto et al., Court of Appeal case number D031075, filed June 13, 1998. Defendants’ appeal of the appointment in California Superior court of a receiver on behalf of plaintiffs. Ruling stayed by the bankruptcy filing of Willis and Elisabeth Carto. Subsequently relitigated in Washington, DC, by Carto in Liberty Lobby and Willis Carto v. US Postal Service and Thomas Lennon, Inc.
  16. Legion for the Survival of Freedom, Inc. v. Willis Carto et al., Court of Appeal case number D037146, filed January 21, 2001. Defendants’ appeal of the post-judgment order setting aside the post-judgment forbearance agreement.
  17. Legion for the Survival of Freedom, Inc. v. Willis Carto et al., Court of Appeal case number D037152, filed 2001. Writ of mandate related to D037146 (above), asking the Court of Appeal for a decision as soon as possible.
  18. Willis Carto et al (petitioners) v. The Superior Court of San Diego County (real party in interest, Legion for the Survival of Freedom), Court of Appeal case D031295, filed on or around June 13, 1998. Petition for a peremptory writ of prohibition, requesting a stay of collection efforts in Legion v. Carto (N64584) pending the outcome of the Carto/Liberty Lobby appeal (D027959). Denied July 15, 1998.
  19. Incorporators of the Legion for the Survival of Freedom Inc. v. Andrew Allen, Friedrich Berg, and John Curry, [Allen, Berg, and Curry were directors of Legion] Harris County (Texas) District Court case number 94-040825, filed August 18, 1994. An attempt by Carto to circumvent the adverse Kerr, Carto and Legion v. Carto rulings (and the unfavorable outcome of the Kerr, Carto appeal) in a different forum, albeit with the same evidence and legal theories. Ruling again in favor of defendants.
  20. Incorporators of the Legion for the Survival of Freedom Inc. v. Andrew Allen, Friedrich Berg, and John Curry. Court of Appeals case number 14-98-00365-CV. The appeal by plaintiffs has been stayed by the bankruptcy filing of Willis Carto.
  21. Legion v. Jean Scott, et al., Orange County (California) Superior court case number 736417, filed September 28, 1994. Action arising out of Carto’s continuing efforts to hold himself out as representing the Legion. Dismissed.
  22. Jean Scott v. Legion, et al., Municipal Court Orange County (California) Harbor Judicial District Small Claims Division case number 94SC6162, filed November 11, 1994. Suit by Carto associate Scott for pay from Legion, after she had left the employment of Legion and had gone to work for Carto. Dismissed.
  23. Willis Carto, Foundation to Defend the First Amendment v. William S. Hulsy, [Hulsy is Legion’s corporate attorney] Orange County (California) Superior Court case number 743630, filed March 2, 1995. Harassment suit by Carto against Legion attorney Hulsy. Plaintiff failed to appear at a hearing on February 22, 1999, and the case was dismissed.
  24. Michael Scott v. Institute for Historical Review, Orange County (California) Superior Court case number 744002, filed March 10, 1995. Harassment suit by one of Carto’s cat’s-paws, based on a fraudulent note given to Scott for no consideration by Vebit (AKA Vibet), a corporation controlled by Carto. Dismissed just prior to trial.
  25. Willis Carto et al. v. Larry Rooker et al., Orange County (California) Superior Court case number 745594, filed April 12, 1995. Refiled In the United States District Court of the Southern District of California as case number 95CV1001 (AJB). Carto’s so-called civil rights suit arising out of a police search of his southern California mansion, conducted by Larry Rooker. Virtually all of this case has been dismissed, and the defendants have made an offer of settlement to which Carto has failed to respond. (Carto also challenged the validity of the search warrant in this case and lost, although the Legion was not involved in this aspect of the case. Carto crony Henry Fischer, whose house was also searched on the same basis as Carto’s, later brought a similar action of his own in Henry Fischer v. Rooker et al., but Legion was not named.) Carto has since lost the rights to any recovery that is not related to personal injury, as a result of his Chapter 7 bankruptcy filing in San Diego.
  26. Jean M. Scott v. Legion, Department of Industrial Relations, Santa Ana, California, case number 18-24669/LS. Second claim by Carto associate Scott for pay from Legion, after she had left the employment of Legion and gone to work for Carto, as well as for unpaid vacation days, unpaid holidays, and rent subsidy. LSF settlement offer rejected by Scott. Case status unknown.
  27. Elisabeth Carto v. Institute for Historical Review, Harbor (California) Municipal Court case number 95C4868, filed September 6, 1995. Harassment suit by Carto claiming that donations made by E. Carto’s mother were really loans that had to be repaid to E. Carto. Cross-complaint for conversion. Dismissed.
  28. Carto v. Raven, Weber, [Raven and Weber work for Legion] Orange County (California) Superior Court case number 783094, filed August 15, 1997. Action arising out of Carto’s claim that defendants were in possession of his property (this claim was virtually identical to a claim made in Carto’s cross-complaint in the Legion v. FDFA case). Settled.
  29. Liberty Lobby, Carto v. Weber, Raven, et al., US District Court (DC) case number 1:98CV0236 (HHK), filed January 29, 1998. Plaintiffs have invented a massive conspiracy against them by defendants, which includes civil RICO, Sherman Anti-Trust Act violations, multiple counts of defamation, etc. First, Carto lost the rights to any recovery that is not related to personal injury, as a result of his Chapter 7 bankruptcy filing in San Diego. More recently, Judge Kennedy dismissed the entire case with prejudice. (4/16/99)
  30. Urtnowski v. Sampson, et al., Orange County (California) Superior Court case number 792119, filed on or about March 25, 1998. Carto’s attorney Urtnowski attempted to sue Sampson [a Legion attorney specializing in collections] alleging improprieties arising out of Sampson’s collection efforts. Dismissed June 25, 1998.
  31. Liberty Lobby, Carto v. Weber, Raven, et al., US Court of Appeals (DC) case number 99-7080, filed May 5, 1999. Appeal of US District Court (DC) case number 1:98CV0236 (HHK). Dismissed August 8, 2000.
  32. Liberty Lobby and Willis Carto v. US Postal Service and Thomas Lennon, Inc., [Lennon is a court-appointed receiver on behalf of Legion] US District Court (DC) case number CIV 98-1109, filed May 11, 1998. Plaintiffs attempted to invalidate Judge Maino’s appointment of a receiver in Legion v. Carto. Ruling from the bench for defendants; written ruling forthcoming.
  33. In re: Liberty Lobby (Title 11 Bankruptcy), US Bankruptcy Court for the District of Columbia case number 98-01046, filed May 13, 1998.
  34. In re: Willis and Elisabeth Carto (Title 7 Bankruptcy), US Bankruptcy Court for the Southern District of California case number 98-08050 H7, filed June 5, 1998.
  35. In re: Willis and Elisabeth Carto (Title 7 Bankruptcy), US Bankruptcy Court for the Southern District of California Adversarial Proceeding case number 98-90374 H7. As the result of a motion for default judgment, Legion received a non-dischargeable judgment in the full amount of the original judgment, plus interest, due to fraud and embezzlement on the part of the Cartos.
  36. In re: Willis and Elisabeth Carto (Title 7 Bankruptcy), US Bankruptcy Court for the Southern District of California Adversarial Proceeding case number 99-90129 H7. Legion was granted an order on their motion for remand against one of Carto’s Texas attornies Joe Izen, regarding the estate of Jack Graham, which Carto stole from Legion, depositing the funds in an account in Texas under the name of Legion (set up by Carto after Legion severed their relationship), improperly using Legion’s federal tax identification number for this purpose.
  37. Liberty Lobby v. Kirk Lyons, Legion for the Survival of Freedom, Mark E. Weber, US District Court (DC) case number 1:00CV02411, filed October 24, 2000. Plaintiffs have invented massive damages, and allege Lanham Act violations, tortious interference with contracts and business relations, business tort of injurious falsehood (sounding in defamation — libel and slander), and common law fraud, as a result of a single fund-raising letter signed by Lyons. Note that even if every statement in this suit were true, Plaintiffs agreed to hold harmless the Defendants as part of a settlement agreement arising out of the collection efforts of Defendants against Plaintiffs (see Legion for the Survival of Freedom, Inc. v. Willis Carto et al., San Diego (California) Superior Court case number N64584). Motion to dismiss, in favor of LSF, granted 9/26/2001.
  38. Weber v. Weber. A divorce court action between Mark Weber of the LSF/IHR and his wife. Carto was helping to pay the attorney fees of Priscilla Weber. (Resolved)
  39. In re: Liberty Lobby (Title 11 Bankruptcy), U.S. Bankruptcy Court (DC). Bankruptcy Case No. 01-1234. An attempt to reopen their previous bankruptcy. (1/22/2001) Denied.
  40. In re: Liberty Lobby (Title 11 Bankruptcy), U.S. Bankruptcy Court (DC). Bankruptcy Case No. 01-1234. An attempt to get around Liberty Lobby’s failure to fulfill the promises and agreements it made in its first bankruptcy by filing a second bankruptcy. (6/8/2001) Dismissed 6/26/2001.
  41. In re: Liberty Lobby (Title 11 Bankruptcy), U.S. Bankruptcy Court (DC). Bankruptcy Case No. 01-1234. An appeal to the bankruptcy judge to mitigate his adverse ruling of 6/26/2001. Denied 7/5/2001.
  42. In re: Liberty Lobby (Title 11 Bankruptcy), U.S. District Court (DC). Civil Action No.: 01-1505 (GK). Bankruptcy Case No. 01-1234. An appeal to the U.S. District Court to mitigate the previous two adverse rulings in bankruptcy court. Denied 9/10/2001.
  43. Hereford Corporation v. LSF. U.S. District Court, Southern District of California. Case No. 01CV2040 DTM (JFS), filed 11/9/2001. Attempt by Carto once again to obfuscate the ownership of his hillside mansion in Escondido, California, in order to delay or stop the sale of the estate as partial repayment for the millions he owes LSF. Dismissed 12/11/2001.
  44. Carto v. Weber, Raven, and IHR. Case number 2001-59722, filed 11/20/2001. Carto’s third defamation suit against these defendants by Mark Lane, this time filed in Texas by good old Howard Singleton. On-going.

Additionally, between June 10, 1993 and October 1, 1993, Liberty Lobby purchased $7,478.80 in books from Legion, not paying for them until the year 2000, and only then under the aegis of the US bankruptcy court in DC.

Finally, in spite of at least four court rulings against him concerning the legitimate representatives of the board of Legion, Carto refuses to hand over corporate documents, the corporate seal, or any other corporation property (including the missing millions).
